Kerbela 55+ Plan Passes 7-6; 15-Day Appeal Clock Is Running

The Knoxville-Knox County Planning Commission approved CR Endeavors' revised plan for the former Kerbela Shriners temple in South Knoxville on Thursday, Aug. 13, 2026, on a 7-6 vote, with a dawn-to-dusk condition on the public pathways. Inside of Knoxville put the product at 217 units. WVLT, writing the same day, called it a 55-and-older residential community. Appeals to City Council must be filed no later than 15 days from the Planning Commission action. That clock runs through Thursday, Aug. 28, 2026. This is not Altura, and it is not the Ebenezer Road file already on the live desk.
The first motion to approve all seven alternative-compliance requests failed 7-6. After the record got muddy enough that Planning's attorney said she was uncomfortable, commissioner Tim Hill made a new motion adding the dawn-to-dusk public-access condition. County-appointed commissioner Wala Habiby switched, and the project passed 7-6. Inside of Knoxville reported the split as almost perfectly geographic: city appointees voted 5-1 against; county appointees voted 6-1 for it.
What did Planning Commission actually approve at Kerbela?
CR Endeavors, a Birmingham-based developer, asked for a Level 3 review under the South Waterfront Form-Based Code because the proposal does not meet seven code requirements on block and lot size, building footprint, setbacks, frontage, and transparency. Level 3 asks whether a project that cannot follow every rule still meets the intent of the code. The approved plan, as Inside of Knoxville and WVLT described it after four trips to Planning, adds pedestrian connections, landscaping and streetscape work, and a public gathering area at Dawson Street and Sevier Avenue.
Knox News, writing Aug. 14 and again Aug. 19, used a 225-unit count for a six-story, age-restricted complex with a courtyard, outdoor pool, underground parking, a north-south pedestrian tunnel toward an observation deck, east-west pathways, and a patio that could take food trucks. The Planning staff form on file at KnoxTNToday (case 4-A-26-OB) described approximately 217 units, later revised to a 217-223 range, on the 5.7-acre split-zoned SW-5 / SW-6 site at 315 Kerbela. This desk copies Inside of Knoxville's 217 as the figure on the Aug. 13 approval story, copies Knox News's 225 as a later published count, and does not invent a third number. The target renter, on every outlet, is adults 55 and older.
Is the Kerbela approval a done deal?
Not if someone appeals. Inside of Knoxville quoted the South Waterfront Advisory and Advocacy Group after the vote: they were still mulling an appeal and would decide before the deadline. City process gives 15 days from the Planning Commission action. Aug. 13 plus 15 days is Aug. 28. If SWAAG or another party files, City Council hears whether the Level 3 alternatives meet the adopted South Waterfront code. CR Endeavors COO Ryan Robertson said in a release that the plan gives the property a thoughtful future and creates public access. Attorney Ben Mullins, speaking for the developer, told Planning the city could not compel public access across private property and that denial over access could raise constitutional issues. Several city-appointed commissioners said that argument cut against approval.
WVLT reported the Kerbela Shriners sold because the transaction funds the organization's operations and local charitable work. A 2024 student-housing idea on the same hilltop never materialized. The temple has been on the site since the 1960s. Demolition is part of the approved concept. Permitting still sits with the City of Knoxville. Knox News wrote that, unless the scope changes or the developer asks the city for money, Planning was the biggest remaining land-use vote — unless an appeal lands.

What does a 55-plus building at the Gay Street Bridge do to a South Knox listing?
It adds a prominent construction site and, later, age-restricted renters. It does not write a new comparable for a $400,000-plus house in Island Home, Vestal, or along Sevier Avenue. Price off the July East Tennessee REALTORS MLS tape: $385,000 median, 10,700-plus active listings, about 5.5 months of supply, 68 days on market. Disclose the Kerbela file if a buyer can see the hilltop from the porch. Do not mark the house up because Planning split 7-6. An appeal, if it is filed by Aug. 28, puts the same site back in front of City Council. That is a neighborhood fact. It is not a 5 percent bump.
South Waterfront owners should keep the form-based code conversation in the listing file. The fight was about public passages, Dawson Street dead space, and whether a tunnel meets the code's pedestrian intent. Buyers walking the Gay Street Bridge will ask. Hand them the Aug. 13 minute and the 4-A-26-OB staff form, not a rumor about 400 units or a waterfront park that is not in the approval.
